Acceptable Use Policy

This Acceptable Use Policy (“AUP”) is part of the Terms of Service between you and DATA MONTANA, a company registered in France at 60 Rue François 1er, 75008 Paris (“Company”, “we”, “us”), governing your use of the Harvenci platform (“Services”).

By using the Services, you agree to comply with this AUP. Violation of this policy may result in suspension or termination of your account, at our sole discretion.

Harvenci is designed for legitimate business use. You may use the Services to:

• Operate AI-powered WhatsApp commerce for your business
• Create and manage online stores and product catalogs
• Process orders and manage customer communications
• Collect payments through integrated payment processing
• Configure and deploy AI conversational agents for customer service and sales
• Participate in the Consultant Partner Program as described in the Terms of Service

You must not use the Services to:

• Violate any applicable local, national, or international laws or regulations
• Infringe upon the intellectual property rights, privacy rights, or other rights of any third party
• Transmit viruses, malware, ransomware, or any other malicious or destructive code
• Engage in fraud, phishing, identity theft, or any form of deceptive practices
• Sell, distribute, or promote illegal or restricted goods or services, including but not limited to controlled substances, weapons, counterfeit goods, or age-restricted products without proper verification
• Facilitate money laundering, terrorist financing, or any financial crimes

You must not:

• Gain or attempt to gain unauthorized access to the Services, other accounts, computer systems, or networks connected to the Services
• Perform vulnerability scanning, penetration testing, or security assessments of the Services without prior written authorization
• Disrupt, degrade, or impair the performance or availability of the Services or any related infrastructure
• Circumvent usage limits, rate limits, security measures, or access controls implemented by the platform
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying algorithms of the Services
• Make excessive API calls or automate usage in a manner that degrades the experience for other users

You must not:

• Resell, redistribute, sublicense, or provide access to the Services to third parties without explicit written authorization from DATA MONTANA
• Use the Services to develop, train, or operate a product or service that competes with Harvenci
• Scrape, crawl, data mine, or systematically extract data from the Services for any purpose not expressly permitted
• Exceed published rate limits or usage quotas, or deliberately circumvent mechanisms designed to enforce such limits

You must not use the Services to create, store, transmit, or distribute:

• Content that is illegal, obscene, defamatory, threatening, or harmful to any individual or group
• Spam, unsolicited messages, chain letters, or bulk messaging not requested by recipients
• Prohibited data types including unencrypted payment card numbers, government-issued identification numbers, or health records, except as necessary and lawful for order processing
• Content that constitutes harassment, threats, stalking, or incitement to violence

In addition to this AUP, your use of WhatsApp through Harvenci must comply with:

• WhatsApp Business Policy: All messaging must adhere to WhatsApp's guidelines for business accounts
• Meta Platform Terms: Your use of the WhatsApp Business API is subject to Meta's platform terms and policies
• WhatsApp Commerce Policy: Products and services sold via WhatsApp must comply with WhatsApp's commerce policies

Specifically, you must not:

• Send bulk unsolicited messages or use the platform for mass spamming
• Message users who have not opted in to receive communications from your business, or fail to honor opt-out requests
• Use a misleading business identity, impersonate another business, or misrepresent the nature of your products or services

When using Harvenci's AI-powered agents, you acknowledge and agree that:

• Accountability: You are fully responsible for the behavior and outputs of AI agents operating under your account, including any messages sent to customers
• Configuration: You must configure AI agents appropriately for your business context, including setting correct product information, pricing, and business policies
• Monitoring: You must actively monitor your AI agents' interactions and outputs, and intervene when the agent produces incorrect or inappropriate responses
• No Deception: You must not use AI agents for deceptive purposes, including generating false reviews, fabricating testimonials, or making misleading claims
• Disclosure: You must disclose the AI nature of your agents to customers when required by applicable law or regulation, and must not actively misrepresent an AI agent as a human

To protect the integrity of the platform and ensure compliance with this AUP:

• We may monitor usage patterns, content, and activity on the Services to detect violations of this AUP
• We may suspend or restrict access to accounts that we reasonably believe are in violation of this policy
• Where possible, we will notify you before taking action against your account, providing an opportunity to address the concern. However, we reserve the right to act immediately when necessary to protect the platform, other users, or comply with legal obligations

If you become aware of any violation of this Acceptable Use Policy, please report it to us so we can investigate and take appropriate action.

Violations of this AUP may result in one or more of the following actions, depending on the severity and nature of the violation:

• Warning: A formal notice identifying the violation and requesting corrective action within a specified timeframe
• Temporary Suspension: Temporary restriction of access to some or all Services while the violation is investigated or remediated
• Permanent Termination: Permanent closure of your account and revocation of access to all Services, in accordance with the termination provisions of the Terms of Service
• Legal Action: Reporting of violations to law enforcement or regulatory authorities as required or permitted by applicable law, and pursuit of legal remedies where appropriate

The action taken will be proportionate to the violation. We reserve the right to determine the appropriate response in our sole discretion.
